These Terms of Service (“Terms”) govern your use of tallytcg.com (the “Site”) and any purchases made from TallyTCG (“we,” “us,” or “our”).

By accessing the Site or purchasing from us, you agree to be bound by these Terms and all policies referenced herein. If you do not agree, do not use the Site or Services.

1. ABOUT TALLYTCG

TallyTCG is an independent retailer of authentic trading card game products. We are not affiliated with, endorsed by, or sponsored by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company International. All trademarks are the property of their respective owners and are used solely for identification purposes.

Our online store is hosted on Shopify Inc., which provides the e-commerce platform used to sell our products.

2. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site and place orders. By using the Site, you represent that you meet this requirement.

3. PRODUCTS & AUTHENTICITY

All products sold by TallyTCG are authentic trading card game products sourced through legitimate retail and secondary markets.

  • Product availability is limited and may change without notice

  • Packaging artwork may vary

  • Pull rates, card contents, and manufacturer errors are outside our control

We do not guarantee pulls, grading outcomes, or aftermarket value.

4. PRICING & AVAILABILITY

Prices are subject to change at any time without notice.

We reserve the right to:

  • Correct pricing errors

  • Cancel orders affected by errors or inaccuracies

  • Limit quantities per customer, household, or order

If an order is canceled, any payment collected will be refunded in accordance with our Refund Policy.

5. FINAL SALE POLICY

Due to the nature of collectible trading cards, all sales are final unless otherwise stated.

Returns or exchanges are only considered if:

  • The incorrect item was sent

  • The item arrived damaged

  • The item is materially different from its description

6. ORDER CANCELLATIONS

Orders may be canceled prior to shipment and are subject to a cancellation fee as outlined in our Refund Policy.

Once an order has shipped, it cannot be canceled.

7. SHIPPING & RISK OF LOSS

Risk of loss transfers to the customer upon carrier acceptance.

We are not responsible for:

  • Packages marked as delivered

  • Delays caused by carriers

  • Address errors provided at checkout

For lost or damaged shipments, we will assist with carrier claims where applicable.

8. BILLING & ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information. Failure to do so may result in order delays or cancellation.

We reserve the right to refuse or cancel orders that appear fraudulent, abusive, or placed for resale.

9. INTELLECTUAL PROPERTY

All Site content, including text, graphics, logos, and images, is the property of TallyTCG or its licensors and may not be reproduced without written permission.

Pokémon and other trademarks belong to their respective owners and are used for identification only.

10. USER CONDUCT

You agree not to:

  • Use the Site for unlawful purposes

  • Attempt to interfere with Site security

  • Misrepresent identity or payment information

  • Scrape, crawl, or exploit Site content

Violation may result in termination of access.

11. THIRD-PARTY SERVICES & LINKS

The Site may include links or tools provided by third parties. We are not responsible for third-party content, policies, or practices.

Use of third-party services is at your own risk.

12. DISCLAIMER OF WARRANTIES

The Site and all products are provided “as is” and “as available.”

We make no warranties, express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Future value or condition

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, TallyTCG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or collectible value.

Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

14. INDEMNIFICATION

You agree to indemnify and hold harmless TallyTCG from any claims arising from:

  • Your breach of these Terms

  • Misuse of the Site

  • Violation of any law or third-party rights

15. TERMINATION

We may terminate or suspend access to the Site at any time for violations of these Terms. Obligations incurred prior to termination will survive.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

17. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance.
